1. Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you ("you," "customer") and RDI Solutions LLC, operating as Dr Printers ("Dr Printers," "we," "us," or "our"), governing your use of the website drprinters.com (the "Site") and the on-site printer and copier repair, maintenance, and related services we provide (the "Services").
By using the Site, submitting a service request, scheduling an appointment, or receiving Services, you agree to these Terms. If you are requesting Services on behalf of a business, you represent that you have authority to bind that business, and "you" includes that business.
If you do not agree to these Terms, do not use the Site or the Services.
2. The Services
2.1 What We Provide
Dr Printers provides physical, on-site repair and maintenance of printers, copiers, multifunction devices, and plotters at the customer's home or business location. Our Services include hardware diagnosis, repair and replacement of physical components (such as fusers, rollers, drums, printheads, control boards, trays, and sensors), preventive maintenance, new equipment assembly, maintenance contracts, and supply of toner and consumables.
2.2 What We Do Not Provide
We are an equipment repair business, not a technical support service. We do not provide remote assistance, software support, or telephone-based technical support. Our telephone line and contact form are used for scheduling, estimates, and service administration only.
2.3 Service Requests and Appointments
Submitting a service request through the Site or by phone is a request for an appointment, not a guarantee of service. All appointments are subject to technician availability and confirmation by us. We will contact you to confirm the appointment time, service address, and a description of the reported problem.
You agree to provide accurate information about your equipment and its symptoms. Accurate information helps our technician arrive with appropriate parts; inaccurate information may require an additional visit.
2.4 Access and Site Conditions
You agree to provide our technician with safe and reasonable access to the equipment at the scheduled time, including any building access, parking arrangements, or escorts required at your location. The equipment should be accessible and connected to power. If our technician cannot access the equipment at the scheduled time, the visit may be treated as a late cancellation under our Cancellation & Rescheduling Policy.
3. Estimates, Pricing, and Payment
3.1 Estimates
Where practical, we provide an estimate before work begins. Standard hardware repairs are offered at flat rates where applicable. Estimates are based on the reported symptoms and our initial diagnosis; if the actual fault differs materially once the equipment is opened, we will inform you and obtain your approval before proceeding with additional work or costs.
3.2 Diagnostic Fees
If a diagnostic visit is performed and you decline the proposed repair, or the equipment is found to be beyond economical repair, a diagnostic fee may apply. Any applicable diagnostic fee will be disclosed to you before the visit is scheduled.
3.3 Payment
Payment is due upon completion of the service visit unless otherwise agreed in writing (for example, under a maintenance contract with invoiced billing). We accept the payment methods communicated at the time of scheduling. For maintenance contracts, billing schedules are set out in the applicable contract documents.
3.4 Taxes
Prices are exclusive of applicable sales taxes unless stated otherwise. You are responsible for any applicable taxes.
4. Parts and Warranties
4.1 Parts
We install genuine manufacturer parts or, where genuine parts are unavailable or you approve otherwise, equivalent-quality replacement parts. Replaced parts that we remove become our property for disposal or return processing unless you request otherwise before the repair.
4.2 Manufacturer Warranties
Where your equipment is covered by a valid manufacturer warranty and the repair falls within the scope of an authorization we hold from that manufacturer, warranty terms are governed by the manufacturer's warranty documentation. Nothing in these Terms modifies or replaces any manufacturer warranty. For equipment or brands for which we do not hold a manufacturer authorization, our Services are independent repairs, and you acknowledge that third-party repair may in some cases affect manufacturer warranty coverage; you are responsible for reviewing your manufacturer's warranty terms.
4.3 Our Workmanship Warranty
We stand behind our work. Our repairs are covered by the workmanship warranty described in our Refund Policy. Except as expressly stated there, and to the maximum extent permitted by law, the Services are provided without other warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.
5. Customer Responsibilities
You are responsible for:
- Backing up any data, stored print jobs, address books, or configurations on your equipment before the service visit. While our repairs are physical and your equipment never leaves your premises, hardware repair carries an inherent risk of data or settings loss on the device;
- Removing confidential documents from output trays, feeders, and work areas before the visit;
- Ensuring a safe working environment for the technician;
- Securing pets and informing us of any site hazards in advance.
6. Maintenance Contracts
Maintenance contracts and service plans are governed by these Terms together with the specific contract document you sign. Where the contract document conflicts with these Terms, the contract document controls for that subject matter. Coverage under maintenance contracts is subject to parts availability as described in the contract. Contracts renew, terminate, and are billed as set out in the contract document.
7. Cancellations, Rescheduling, and Refunds
Cancellations and rescheduling are governed by our Cancellation & Rescheduling Policy. Refunds are governed by our Refund Policy. Both are incorporated into these Terms by reference.
8. Acceptable Use of the Site
You agree not to:
- Submit false, misleading, or fraudulent service requests;
- Use automated systems (bots, scrapers) to submit forms or harvest content from the Site;
- Attempt to interfere with the Site's operation or security;
- Use the Site for any unlawful purpose.
We may refuse service, cancel appointments, or block access to the Site where we reasonably believe this section has been violated.
9. Intellectual Property
The Site and its content (text, layout, logos, and images we own) are our property or used with permission and are protected by intellectual property laws. Manufacturer names, logos, and product names appearing on the Site are trademarks of their respective owners and are used for identification purposes; their appearance does not imply endorsement except where an official partnership is expressly stated.
10. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim arising out of or relating to the Services or these Terms is limited to the amount you paid us for the specific service visit giving rise to the claim;
- We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, business interruption, or the cost of substitute equipment or services;
- We are not liable for pre-existing damage to equipment, faults unrelated to the work we performed, or damage caused by continued use of equipment we have identified as requiring repair.
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence or willful misconduct.
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of law, or inaccurate information you provide in connection with the Services, except to the extent caused by our negligence or misconduct.
12. Dispute Resolution
12.1 Informal Resolution First
If you have a dispute with us, contact us first at service@drprinters.com or +1 (934) 470-4670. Most concerns can be resolved quickly and informally, and we will work with you in good faith to do so.
12.2 Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute not resolved informally shall be brought in the state or federal courts located in New York County, New York, and you consent to their jurisdiction, except that either party may bring an eligible claim in small claims court in the county where the service was performed.
13. Changes to the Services or Terms
We may update these Terms from time to time. The "Last Updated" date will reflect the most recent version, and material changes will be indicated by a notice on the Site. Changes apply prospectively; the Terms in effect at the time you booked a service visit govern that visit. Continued use of the Site or Services after changes take effect constitutes acceptance.
14. General
- Entire agreement: these Terms, together with the policies incorporated by reference and any signed maintenance contract, are the entire agreement between you and us regarding the Services.
- Severability: if any provision is found unenforceable, the remainder remains in effect.
- No waiver: our failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a business transfer as described in our Privacy Policy.
- Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control, including weather, transportation disruptions, and parts supply shortages.
